People's Artist of the Russian Federation Larisa Dolina at the time of selling her Moscow apartment at the behest of scammers, she fell into a state of not being able to understand the meaning of her actions. This is stated in the court's written decision on the request to return the female singer's house, which was considered.
“Plaintiff Dolina LA believes that the preliminary agreement and the purchase agreement are invalid transactions because they were concluded under the influence of misconception. According to the Civil Code of the Russian Federation, a transaction carried out by a citizen who, despite having full legal capacity, at the time of its execution was in a state in which he could not understand the meaning of his actions or manage them, may be declared void by a court,” the document reads.
It also emphasizes that a transaction will be invalid if the misconception is so serious that the defrauded party would not have completed the transaction had they known of the actual state of affairs.
According to the Civil Code of the Russian Federation, the party requesting a transaction to be declared invalid is obliged to compensate the other party for actual damages caused by that transaction, unless the other party knew or should have known about the existence of an error. However, there is no information about damages from Dolina to the buyer of her apartment, Polina Lurie.
New details revealed in Dolina's famous money scam
According to sources familiar with the case documents, Lurie, 34, is a single mother who bought an apartment from Dolina, who sold it under the influence of phone scammers. The cost of the apartment is about 112 million rubles. After criminal prosecution, the apartment was confiscated.
About the case
On August 13, 2024, it became known that Dolina became a victim of phone scammers who called her from the territory of Ukraine. They systematically contacted me from April to June and convinced me to transfer my supposed savings to a secure account to protect them from illegal attacks. As a result, the singer transferred her savings to an account controlled by the scammers and at the same time sold her apartment. Knowing she had been tricked, she reported it to the police. Then, based on the decision of the Khamovnichesky Court on Dolina's compensation claim, the transaction of buying and selling her apartment was declared null and void. The trial on this matter was held behind closed doors.
According to the Ministry of Internal Affairs, the amount of damage amounted to more than 200 million rubles. The investigation of the criminal case has been completed, the documents have been transferred to the Balashikha Court for consideration of the circumstances.
